1.1 This Shipping & Delivery Policy applies to all purchases made from Desnic Sports through desnicsports.co.za, including deliveries arranged to a customer’s address, store collection where offered, and any pickup-point or courier services made available on the Website from time to time.

3. Delivery areas
3.1 Desnic Sports delivers within the Republic of South Africa only, unless we expressly agree otherwise in writing.
3.2 We deliver to valid physical street addresses. We may refuse delivery to:
P.O. Boxes;
Private bags;
addresses that cannot reasonably be serviced by our courier network;
mines, farms, plots, security estates, government sites, hospitals, schools or campuses where access rules prevent normal delivery;
addresses regarded by the courier as high-risk, inaccessible or incomplete.

4. Shipping partners and platform
4.1 Desnic Sports uses Bob Go as its shipping and delivery management platform.
4.2 Bob Go is a shipping platform that connects merchants to multiple courier and pickup-point partners, supports waybill generation, and provides shipment tracking and order management tools. Bob Go’s own official site states that it connects stores to courier partners and centralises quote comparison, bookings and tracking.
4.3 Desnic Sports may from time to time use one or more third-party courier partners available through Bob Go or otherwise, depending on:
destination;
parcel size and weight;
service level selected;
operational coverage;
cost;
product type; and
system availability.
4.4 The identity of the courier used for a shipment may be shown at checkout, in the order confirmation, on the tracking page, or in related delivery communications.
4.5 Tracking information displayed through Bob Go or any Desnic Sports tracking page is dependent on data supplied by the actual courier partner. Bob Go’s current terms state that the tracking information provided is the tracking information received from the courier performing the courier services.
5. Shipping options
5.1 The delivery options shown on the Website may vary by order, destination, stock location and parcel characteristics.
5.2 Desnic Sports may offer one or more of the following:
standard courier delivery;
express courier delivery, where available;
pickup-point delivery, where enabled;
click and collect / store collection, where enabled;

6. Order processing times

7.6 Desnic Sports will not be liable for delay where the delay is caused by factors beyond our reasonable control, including courier disruption, access issues, weather, strikes, unrest, power failures, cyber incidents or supplier delays, subject always to your non-excludable rights under law.
8. Shipping fees

9. Delivery address accuracy

11. Receipt of delivery and risk

11.3 You must inspect the outer packaging and goods as soon as reasonably possible after delivery or collection.
11.4 If the parcel appears tampered with, damaged or incomplete, you should:
note the issue on the courier’s waybill or device where possible;
take photographs before opening, where reasonably possible;
notify Desnic Sports promptly.
12. Failed delivery attempts
12.1 If no one is available to receive the parcel, the courier may:
attempt re-delivery;
contact you to reschedule;
hold the parcel at a depot or pickup point;
or return it to sender.
12.2 The number of delivery attempts and holding periods may vary by courier.
12.3 Desnic Sports may charge additional delivery, return, storage, re-handling or administration fees where a failed delivery was caused by:
an incorrect address;
no one being available;
refusal to accept the parcel;
repeated non-response by the recipient;
access restrictions not disclosed in advance.
12.4 If a parcel is returned to us due to customer fault, we may:
re-dispatch it once additional charges are paid;
cancel the order and refund the purchase price less direct delivery and return costs where lawful;
or hold the order pending your instructions for a reasonable period.
13. Pickup-point and locker deliveries
13.1 If Desnic Sports offers pickup-point or locker delivery, the specific pickup-point terms shown at checkout will apply.
13.2 Bob Go’s current terms state that pickup-point deliveries are subject to strict drop-off and collection windows and that if the parcel is not collected in time it will be automatically returned to sender, with associated return costs charged to the merchant. Bob Go currently lists examples including Bob Box: 36 hours from ready-for-pickup and Pargo: 5 business days from ready-for-pickup.
13.3 If a customer fails to collect a pickup-point parcel within the permitted timeframe:
the parcel may be returned to sender automatically;
the original shipping fee may be non-refundable;
return-to-sender and re-dispatch costs may be charged to the customer where lawful and where the failure was caused by the customer.
13.4 You are responsible for monitoring pickup notifications and collecting within the stated period.
14. Click and collect / store collection
14.1 If Click and Collect is enabled on the Website, you may collect eligible orders from our designated store or collection point.
14.2 Store collection is only available after you receive a notification confirming that the order is ready for collection.
14.3 You must not attempt to collect before receiving the ready-for-collection confirmation.
14.4 When collecting, you may be required to present:

16. High-value goods, risk items and restricted shipments
16.1 Bob Go’s official restrictions page states that some items are “ship at your own risk” or prohibited entirely depending on courier rules, and its insurance page states that courier insurance is subject to packaging rules, item exclusions and courier-specific limits.
16.2 Desnic Sports reserves the right to refuse shipment of any item that:
cannot lawfully or safely be transported;
is restricted by the selected courier;
is insufficiently packaged for transport;
exceeds courier size, weight or value thresholds;
requires special insurance or handling we do not offer.
16.3 If a product is sold by Desnic Sports but later found to be unsuitable for the selected delivery method, we may contact you to:
arrange an alternative shipping method;
request an additional charge;
arrange store collection;
or cancel and refund the order before dispatch.
17. Insurance, loss and damage in transit
17.1 Where courier insurance is included or selected, that cover is subject to the courier’s own terms, exclusions, valuation rules and packaging requirements.
17.2 Bob Go’s official insurance page states that Bob Go is not the insurer, that insurance cover is an add-on arranged by delivery partners, and that claims depend on courier requirements and exclusions. It also states that claims are based on the lower of the declared value or the cost price of the goods, not retail or order value.
17.3 Desnic Sports may, but is not obliged to, facilitate or assist with courier insurance claims.
17.4 To preserve any possible claim, you must notify us of any transit loss, visible damage, tampering or shortage as soon as reasonably possible and preferably within 48 hours after delivery.
17.5 Bob Go’s current insurance guidance states that claims must be reported to the delivery partner and Bob Go within 48 hours after delivery, with supporting documentation submitted within the courier’s required timeframe.
17.6 Failure to report promptly, preserve packaging, provide photographs, or cooperate with the claim process may result in refusal of the claim by the courier or insurer.
17.7 Nothing in this clause limits your statutory rights where the CPA requires a different outcome.
18. Delivery delays and customer remedies
18.1 If Desnic Sports tenders delivery at a location, date or time other than as agreed, the CPA gives the consumer certain remedies, including accepting the delivery, requiring delivery at the agreed place/date/time if still possible, or treating the goods as unsolicited where the law allows.
18.2 If there is a material delay in your order, you should contact us first so we can investigate with the relevant courier or stock source.
18.3 Depending on the circumstances and applicable law, Desnic Sports may:
provide an updated estimated delivery date;
offer an alternative courier or service level;
offer store collection if practical;
split the order and ship available goods first;
or cancel the affected item or order and refund the amount paid.
19. Delivery charges and refunds
19.1 Shipping fees are generally non-refundable once the parcel has been booked, collected or dispatched, except:
where the law requires otherwise;
where Desnic Sports dispatched the wrong item;
where the order is cancelled by us before dispatch;
or where we agree otherwise in writing.
19.2 If an order is cancelled after dispatch because the customer gave an incorrect address, failed to accept delivery, failed to collect, or refused the parcel without lawful basis, Desnic Sports may deduct:
original shipping charges;
return-to-sender costs;
storage charges;
banking or refund processing costs where lawful.
19.3 If a refund is due on goods purchased through a third-party credit or instalment provider, any shipping fee refund will be subject to that provider’s reversal mechanics and the original payment route.
20. Promotions, free shipping and pricing errors affecting delivery

21. CPA, ECTA and NCA alignment

21.2 The NCA may become relevant where a purchase is funded through a third-party credit agreement, instalment arrangement or other regulated credit structure. In such cases:
the delivery of goods remains subject to the CPA;
the credit relationship remains subject to the finance provider’s terms and the NCA, where applicable.

1.1 This Returns, Refunds and Exchanges Policy applies to all purchases from Desnic Sports, whether made:

through any in-store kiosk or digital order point linked to the Website;
by click-and-collect where the order was placed electronically; or
in store, unless clearly stated otherwise.
1.2 This Policy must be read together with our:

any product-specific terms, manufacturer instructions or promotional conditions published by us from time to time.
1.3 This Policy is intended to comply with applicable South African law, including:

where a purchase is funded through a credit agreement or third-party instalment facility, the National Credit Act 34 of 2005 (“NCA”).
2. Important legal notice

4. General return process
4.1 Before returning any item, you must contact Desnic Sports and provide:
your order number or proof of purchase;
your full name and contact details;
the product name, SKU or barcode if available;
the reason for the return;
clear photographs where the issue relates to damage, defect, incorrect item, missing parts or courier damage.
4.2 No return should be sent back without return instructions from us, unless you are returning the item directly in store.
4.3 We may refuse, delay or reverse a return process where:
no valid proof of purchase is supplied;
the item returned does not match the item purchased;
the item has been used, altered, damaged, installed, washed, personalised or tampered with contrary to this Policy;
the return request is fraudulent, abusive or unlawful;
the return falls outside the permitted legal or discretionary return category.
4.4 A return reference number or instruction from us does not automatically mean that a refund is approved. The final remedy depends on inspection, legal entitlement, stock availability, payment verification and this Policy.
5. Proof of purchase
5.1 Returns, refunds and exchanges generally require one of the following:
original tax invoice;
order confirmation;
collection slip;
payment confirmation;
gift receipt, where applicable;
any other proof reasonably linking the goods to the original purchase.
5.2 Desnic Sports may decline a discretionary return or exchange if no valid proof of purchase is provided.
5.3 For statutory defective-goods claims, we may still take reasonable steps to verify purchase from our records even if the original slip is unavailable.
6. Categories of returns
Desnic Sports recognises the following different return categories:
6.1 Defective, unsafe or poor-quality goods
This category applies where goods do not meet the CPA standards of quality, durability, safety or fitness for purpose.
6.2 Incorrect, incomplete or damaged-on-arrival orders
This category applies where:
you received the wrong product;
items are missing;
the order arrived visibly damaged;
the order does not materially match what was purchased.
6.3 Goods unsuitable for a particular disclosed purpose
This category applies where you clearly communicated a specific purpose to us before purchase, and the goods prove unsuitable for that purpose within the legal period.
6.4 Online cooling-off returns
This category applies where section 44 of ECTA applies to an electronic transaction.
6.5 Direct marketing cooling-off returns
This category applies only where the CPA’s direct-marketing cooling-off right applies and ECTA section 44 does not apply to that transaction.
6.6 Discretionary change-of-mind or incorrect-selection returns
This category applies only where Desnic Sports chooses to allow a return for:
buyer’s remorse;
change of mind;
incorrect size chosen by customer;
incorrect colour selected;
duplicate gift;
no longer wanted.
These are not automatic legal rights and remain subject to this Policy.
7. Defective, unsafe or poor-quality goods
7.1 Under the CPA, consumers have an implied six-month warranty of quality on goods supplied in the ordinary course of business.
7.2 If goods fail to meet the standards in section 55 of the CPA, you may return them within 6 months after delivery and, at your election, choose one of these remedies:
repair;
replacement; or
refund.
7.3 If the goods are repaired and the same defect is not remedied, or a further defect appears within 3 months after repair, you are entitled to a replacement or refund.
7.4 These CPA rights are in addition to any manufacturer warranty and are not replaced by it.
7.5 Desnic Sports may inspect, test or submit goods for technical assessment before confirming whether a defect is due to:
a manufacturing issue;
an inherent fault;
misuse;
abuse;
accidental damage;
wear and tear;
improper storage;
failure to follow instructions;
unauthorised repair or modification.
7.6 Desnic Sports may reject a defective-goods claim where the product failure was caused by:
misuse, abuse or negligence;
normal wear and tear;
fading, scuffing, shrinkage, stretching, sole wear or abrasion consistent with ordinary use;
improper cleaning, washing, drying, oiling, stringing, gripping, fitting, use or storage;
alterations, branding, embroidery, printing, cutting, resizing, restringing or repair by anyone other than the manufacturer or an approved service provider;
product use contrary to manufacturer instructions or intended purpose.
7.7 If the goods are genuinely defective under the CPA, the goods must be returned at Desnic Sports’ risk and expense.
8. Incorrect, damaged, incomplete or mismatched orders
8.1 If we accidentally send you:
the wrong item;
the wrong size or colour compared to what was ordered;
an incomplete order;
a damaged item; or
goods that materially differ from the order,
please notify us as soon as reasonably possible, and preferably within 48 hours, with photographs and your order details.
8.2 Prompt reporting helps us investigate with the courier or supplier.
8.3 If the claim is verified, Desnic Sports may, at your election where the law provides a choice, or otherwise at our operational discretion where the law does not prescribe the remedy:
replace the item;
complete the missing item;
repair the item if appropriate; or
refund the affected item.
8.4 For verified wrong-item, incomplete or damage-on-arrival claims, Desnic Sports will arrange collection or reimburse approved direct return costs where applicable.
8.5 You must keep:
the original packaging where reasonably available;
all accessories, manuals, tags and bundled items;
the damaged item itself; and
clear images of the parcel and contents,
until the claim has been resolved.
9. Goods unsuitable for a specific disclosed purpose
9.1 If, before the sale, you clearly informed Desnic Sports of a specific purpose for which you wanted the goods, and the goods were supplied on that basis, you may have a right under the CPA to return the goods if they are unsuitable for that purpose.
9.2 In that case, the goods must be reported and returned within 10 business days after delivery.
9.3 Where this legal category applies, the return is at Desnic Sports’ risk and expense.
9.4 This clause does not apply where:
the purpose was not clearly communicated before purchase;
you selected the item without relying on our skill or recommendation;
the item was obviously chosen contrary to advice given;
the product was used outside its intended scope.
10. Online cooling-off right for electronic transactions
10.1 Where section 44 of ECTA applies, you may cancel an eligible online transaction within 7 days after receiving the goods, without giving a reason and without penalty.
10.2 In that case:
the only charge that may be levied is the direct cost of returning the goods;
the refund must be made within 30 days after cancellation;
the goods must be returned in a condition consistent with reasonable inspection only.
10.3 The ECTA cooling-off right does not apply to all transactions. It does not apply to, among other things:
goods made to your specifications;
clearly personalised goods;
goods that cannot by reason of their nature be returned;
goods likely to deteriorate or expire rapidly;
certain financial-service transactions and other exclusions set out in section 44.
11. Direct-marketing cooling-off right
11.1 Where a transaction resulted from direct marketing, and where section 16 of the CPA applies rather than ECTA section 44, you may rescind the transaction within 5 business days after the later of:
the date the agreement was concluded; or
the date the goods were delivered.
11.2 In such a case, any refund must be processed in accordance with the CPA timeframes.
11.3 This clause applies only where the legal requirements for direct marketing are actually met.
12. Discretionary returns for change of mind or incorrect selection
12.1 As a business courtesy, and subject strictly to this Policy, Desnic Sports may allow a return or exchange request for non-defective goods within 7 calendar days from:
delivery, for online orders; or
purchase, for in-store purchases.
12.2 This discretionary 7-day courtesy return is not a statutory right and may be refused in Desnic Sports’ sole discretion if the conditions below are not met.
12.3 To qualify for a discretionary return or exchange, the goods must:
be unused and unworn;
be in original resaleable condition;
be unwashed;
be free from odours, marks, sweat, dirt, grass, court dust, sand, chalk or field use;
include the original packaging where applicable;
include all accessories, inserts, manuals and bundled items;
still have all swing tags, labels, seals and hygiene protectors attached;
not be personalised, branded, altered or special-order goods.
12.4 Where Desnic Sports approves a discretionary return for change of mind, wrong size chosen by the customer, wrong colour chosen by the customer or similar reasons:
Desnic Sports may offer an exchange, store credit or refund, in its discretion, unless the law requires otherwise;
all direct courier, collection, re-delivery, banking, handling or reconditioning costs may be deducted or charged where lawful;
the customer bears the return risk and cost unless Desnic Sports agrees otherwise in writing.
12.5 This clause is deliberately stricter than the CPA because it deals only with voluntary, non-defective returns.
13. Non-returnable and non-exchangeable items
To the fullest extent permitted by law, the following items are not eligible for discretionary return, refund or exchange merely because you changed your mind, selected incorrectly, or no longer want them:
13.1 Sale, promotional, clearance, discounted, marked-down, end-of-range or outlet items.
13.2 Special-order, custom-order or supplier-sourced-on-request items.
13.3 Teamwear, personalised, embroidered, printed, engraved, branded, heat-pressed or altered items.
13.4 Items changed by value-added services, including but not limited to:
racket restringing or regripping;
bat preparation or oiling;
sharpening;
embroidery;
printing;
heat transfer;
name/number application;
size alteration or fitting modification.
13.5 Hygiene-sensitive items, including where applicable:
underwear;
swimwear;
socks;
compression underlayers worn against the skin;
mouthguards;
gumshields;
opened supplements or consumables if ever sold;
water bottles, hydration products or personal-care items once opened or used.
13.6 Gift cards, vouchers, coupons and store credits, except where required by law.
13.7 Installed, assembled, used or affixed goods.
13.8 Items returned without essential parts or accessories.
13.9 Nothing in this clause removes your rights in respect of proven defective goods under the CPA or eligible ECTA cooling-off returns.
14. Condition of returned goods
14.1 All returned goods are subject to inspection.
14.2 Desnic Sports may refuse a discretionary return or reduce the refund where goods are not returned with:
original accessories;
laces, studs, covers, guards, bags, cases or inserts;
manufacturer packaging;
proof of purchase;
tags and labels.
14.3 If a returned item shows signs of use beyond what is reasonably necessary to inspect it, Desnic Sports may:
refuse the return;
return the item to you at your cost;
deduct a reasonable amount for loss in value, reconditioning or missing components, where lawful.
15. Footwear, apparel and sports-equipment specific rules
15.1 Footwear: shoes, boots, trainers and cleats returned for discretionary reasons must be unworn other than minimal indoor try-on, and the soles must be clean and unmarked.
15.2 Apparel: clothing returned for discretionary reasons must be unworn, unwashed and free from deodorant, make-up, perfume, pet hair, stretching, tears or alterations.
15.3 Protective gear and equipment: helmets, guards, braces and similar items may be inspected for hygiene, impact history and safety integrity before any decision is made.
15.4 Rackets, bats and balls: damage caused by ordinary wear, misuse, impact abuse, toe/yorker damage, environmental damage, incorrect string tension, oiling, overuse or improper preparation is not automatically a manufacturing defect and may be assessed case by case.
16. Exchanges
16.1 Exchanges are subject to stock availability.
16.2 If the replacement item costs more, you must pay the difference before the replacement is released.
16.3 If the replacement item costs less, Desnic Sports may:
refund the difference to the original payment method;
issue store credit; or
process the exchange in another lawful and reasonable manner.
16.4 Desnic Sports is not obliged to hold replacement stock pending return transit unless expressly agreed in writing.
17. Refund method and timing
17.1 Refunds will generally be processed to the same payment method or payment source used for the original transaction, unless the law or payment platform requires otherwise.
17.2 Refunds may be delayed while we:
inspect the returned goods;
verify the original transaction;
wait for the goods to be received back;
complete a technical or supplier assessment;
verify bank or gateway details.
17.3 Where ECTA section 44 applies, the refund must be made within 30 days after cancellation.
17.4 For verified wrong-item, damaged or defective claims, refunds will be processed within a reasonable time after approval.
17.5 Shipping or delivery charges are generally not refunded for discretionary returns, but may be refunded where the item was defective, materially not as ordered, or where the law requires it.
17.6 Any promotional voucher, loyalty reward, discount benefit or free item linked to the original transaction may be reversed, cancelled or recalculated when a refund is processed.
18. Credit, instalment and finance transactions
18.1 Desnic Sports does not extend consumer credit by default under this Policy.
18.2 If a customer uses a third-party credit, instalment or buy-now-pay-later provider, any related credit agreement remains subject to:
that provider’s own approval criteria;
the provider’s own refund mechanics;
the underlying finance agreement; and
the National Credit Act, where applicable.
18.3 In those cases:
any approved refund may first be processed back to the credit or instalment provider;
account adjustments may be subject to that provider’s settlement cycle;
Desnic Sports is not responsible for interest, fees or credit charges charged by the finance provider unless required by law.
18.4 The NCA regulates consumer credit agreements and related credit-market conduct in South Africa. If Desnic Sports later decides to offer store accounts, deferred-payment credit or similar facilities directly, separate NCA-compliant credit terms would be required.
19. Incorrect pricing, website errors, product changes, specials and promotions
19.1 Desnic Sports makes reasonable efforts to ensure that product descriptions, images, stock availability, specifications, promotional messaging and pricing are accurate.
19.2 However, Desnic Sports reserves the right to correct:
typographical errors;
feed errors;
supplier import errors;
image mismatches;
stock errors;
pricing errors;
promotional or coupon errors;
technical glitches;
obsolete information,
at any time before dispatch, collection or final fulfilment, subject to applicable law.
19.3 Desnic Sports will not intentionally engage in misleading pricing, false advertising or bait marketing. The CPA prohibits false, misleading or deceptive representations and also prohibits advertising goods at a stated price in a misleading way as to their availability.
19.4 Where a special, promotion or advertised offer expressly states:
a date range;
quantity limit;
customer limit;
store limitation;
online-only limitation; or
“while stocks last” or similar wording,
that offer applies only within those stated limits.
19.5 Where an obvious or inadvertent error appears on the Website or in online advertising, Desnic Sports may, where lawful:
withdraw the item or promotion;
correct the price or content;
cancel affected orders before dispatch; and
refund any amount already paid.
19.6 Where the law requires a different remedy in relation to a misleading advertisement or stated stock limit, Desnic Sports will comply with that law. The CGSO’s pricing-error guidance notes that suppliers can reduce risk by clearly stating limits and validity periods, while the CPA requires advertised goods at a specified price to be available to the extent of any expressly stated limits.
19.7 Product ranges, colours, styles, packaging, logos, technical specifications and supplier availability may change without notice.
19.8 Desnic Sports may discontinue products, withdraw promotions, substitute equivalent stock where lawful and reasonable, or cancel unfulfillable orders before dispatch.
20. Refusal of abusive or suspicious returns
20.1 Desnic Sports reserves the right to refuse returns, exchanges or refunds, and to suspend accounts, where we reasonably suspect:
fraud;
return abuse;
wardrobing or single-event use;
use-and-return behaviour;
false defect claims;
substitution of goods;
tampering with barcodes, serial numbers or tags;
unlawful or bad-faith conduct.
20.2 We may keep records of return activity for fraud prevention, audit and legal compliance purposes, subject to our Privacy & Cookies Policy.
21. Goods purchased as gifts
21.1 Gift recipients may return eligible items only with valid proof of purchase or gift receipt.
21.2 Desnic Sports may choose to issue:
an exchange;
a gift card;
store credit; or
another lawful remedy,
instead of refunding cash to a gift recipient.
22. Bundles, sets and promotional packs
22.1 If goods were sold as a set, bundle, kit, combo or promotional pack, Desnic Sports may require all bundle components to be returned together for a full refund, unless the law requires otherwise.
22.2 If only part of a bundle is returned, Desnic Sports may:
refuse the partial discretionary return;
recalculate the original bundle discount;
deduct the value of non-returned components;
replace only the defective component where appropriate.
23. Manufacturer warranties
23.1 Manufacturer warranties apply in addition to your statutory rights where applicable.
23.2 Manufacturer warranties may have their own:
claim procedures;
inspection standards;
exclusions;
repair methods;
territory limits;
time periods.
23.3 Desnic Sports may assist to facilitate a manufacturer warranty claim, but this does not mean the claim is automatically approved.
23.4 Where the CPA gives the consumer a direct remedy against Desnic Sports, Desnic Sports will not refuse that remedy solely because a manufacturer warranty exists.
24. Return shipping and collection costs
24.1 Defective goods under CPA: returned at Desnic Sports’ risk and expense.
24.2 Wrong item / incomplete / damage on arrival: Desnic Sports will ordinarily bear approved collection or return costs.
24.3 Unsuitable for disclosed purpose / not examined before delivery / mixed goods under CPA section 20: returned at Desnic Sports’ risk and expense.
24.4 ECTA online cooling-off returns: returned at the customer’s direct cost.
24.5 Discretionary change-of-mind returns: returned at the customer’s risk and cost, unless Desnic Sports agrees otherwise.

26.1 Desnic Sports may amend this Policy from time to time.
26.2 The version published on desnicsports.co.za at the time of the relevant transaction will generally apply, subject to any non-excludable legal rights that accrued earlier.

4.1 You may use the Website only if you have legal capacity to enter into binding agreements under South African law.
4.2 If you are under 18, you may use the Website only with the involvement and consent of your parent or legal guardian.
4.3 If you place an order on behalf of a company, school, club, team, trust, partnership or other entity, you warrant that you are duly authorised to bind that entity.

5.1 We make reasonable efforts to ensure that product descriptions, specifications, pricing, imagery, size information, availability and other Website content are accurate and up to date.

packaging may vary from images shown;
size guides are guides only and are not guarantees of fit;
products may be updated, replaced or discontinued by manufacturers without notice;
certain stock may be subject to supplier confirmation.
5.3 Product images are for illustrative and merchandising purposes. Accessories, add-ons or secondary items shown in an image may not be included unless expressly stated in the product description.
5.4 Sports, training, protective and performance equipment must be selected, fitted, used, maintained and supervised appropriately. Desnic Sports is not responsible for injury, damage or loss arising from improper sizing, improper use, misuse, abuse, alterations, inadequate supervision, or failure to follow manufacturer instructions.
5.5 Any advice given on the Website, in-store, by phone, email, chat, social media or otherwise is general product guidance only and does not amount to a guarantee that a product is suitable for your particular purpose unless we have expressly agreed to that in writing.
6. Account registration and security
6.1 You may be required to create an account to access certain Website functions.
6.2 You agree to provide accurate, current and complete information and to keep it updated.
6.3 You are responsible for:
keeping your username and password confidential;
restricting access to your account;
all activities that occur under your account.
6.4 You must notify us immediately if you suspect unauthorised access to your account.
6.5 We may suspend, restrict or terminate your account if we reasonably believe that:

8. Orders and conclusion of sale
8.1 Displaying products on the Website does not constitute a binding offer by us. It is an invitation to do business.
8.2 Your order is an offer to purchase the goods selected by you subject to these Terms.
8.3 No sale is concluded until we accept your order. We may accept or decline an order in whole or in part.
8.4 We may refuse or cancel an order, including after payment has been authorised, where:
stock is unavailable;
there is a genuine pricing, description or technical error;
the order is flagged as suspicious, unlawful or fraudulent;
we cannot verify payment;
the delivery address falls outside our service capabilities;
supplier constraints prevent fulfilment;
the customer is in breach of these Terms.
8.5 If we cancel an order after receiving payment, we will refund the amount actually received by us for the cancelled item or order, subject to applicable law.
8.6 Placing goods in a cart or wishlist does not reserve stock.
8.7 We reserve the right to limit order quantities, per-customer quantities and promotional quantities.
8.8 ECTA requires an online supplier to display certain information, allow consumers to review the transaction, correct errors and withdraw before finally placing the order, and to maintain sufficiently secure payment systems. These Terms are intended to operate alongside those requirements.
9. Pricing, VAT, promotions and pricing errors
9.1 Unless stated otherwise, prices displayed on the Website are in South African Rand (ZAR).
9.2 Prices include VAT only if expressly indicated.
9.3 Delivery charges, payment surcharges if any, and other additional charges will be shown at checkout or before final order submission where applicable.
9.4 We may change prices at any time before order acceptance.
9.5 If a product is listed at an obviously incorrect price or with an obvious error due to a typographical, system, feed, import or human error, we may cancel the order before dispatch and refund any payment received.
9.6 Promotions, discount codes, bundles, giveaways and special offers:
are subject to availability;
may be limited by date, quantity, category, product or customer;
may not be combined unless expressly stated;
may be withdrawn, corrected or extended at our discretion;
are void where prohibited by law.
9.7 Sale, promotional, clearance and end-of-range items may be subject to separate pricing, stock and return conditions, but any non-excludable statutory rights remain unaffected.
10. Payment
10.1 We accept the payment methods displayed on the Website from time to time.
10.2 All payments must be made in full before dispatch or collection, unless we expressly agree otherwise in writing.
10.3 Payment is processed via third-party payment service providers using their own systems, rules and verification measures.
10.4 By submitting payment details, you warrant that:
you are authorised to use the payment method;
the payment details are valid;
sufficient funds or credit are available.
10.5 We may require additional verification before accepting an order.
10.6 Ownership in the goods remains with Desnic Sports until full cleared payment has been received.
10.7 We do not intentionally store full card details unless expressly stated and lawfully secured through an appropriate payment provider environment.
11. Delivery, collection, risk and performance
11.1 We will use reasonable efforts to deliver within the estimated time indicated on the Website or otherwise communicated to you, but delivery times are estimates only.
11.2 Delivery is subject to stock availability, payment confirmation, courier coverage, public holidays, force majeure events and operational constraints.
11.3 Risk in the goods passes to you upon:
delivery to the delivery address provided by you; or
collection by you or your authorised representative.
11.4 You are responsible for ensuring that:
the delivery address is accurate and accessible;
someone authorised is available to receive the parcel where signature or attendance is required;
collection is made timeously where collection is selected.
11.5 We may treat delivery as completed if a parcel is delivered to the address, person, security desk, reception area, collection point or authorised recipient indicated in your order or reasonably associated with your instructions.
11.6 We may use third-party couriers, aggregators and logistics providers. Their operational constraints, scanning events, routing systems and delivery procedures may affect timing and tracking.
11.7 If goods are returned to us because of a failed delivery caused by your error, refusal, absence, incomplete details or non-collection, we may charge reasonable re-delivery, re-handling or storage costs.
11.8 ECTA also regulates the supplier’s performance period and makes consumer rights under that Chapter non-excludable.
12. Inspection on delivery and reporting issues
12.1 You should inspect the goods as soon as reasonably possible after delivery or collection.
12.2 Any visible delivery damage, shortage, incorrect item or packaging tampering should be reported to us as soon as possible, and preferably within 48 hours after delivery or collection, to help us investigate with the courier or relevant supplier.
12.3 The reporting period in clause 12.2 does not limit any rights you may have under the CPA in respect of defective, unsafe or failed goods.
13. Cancellations, returns, exchanges and refunds
13.1 All cancellations, returns, exchanges and refunds are subject to these Terms, our Returns & Refunds Policy, and applicable law.
13.2 Eligible online purchases: where section 44 of ECTA applies, a consumer may cancel an electronic transaction for goods within 7 days after receipt, without reason and without penalty, provided the goods are returned in the required condition. In that case, the only charge that may be levied is the direct cost of returning the goods, and the refund must be made within the period prescribed by law.
13.3 Defective goods: if goods fail to satisfy the CPA’s standards of quality, safety, durability or fitness, the consumer may, within 6 months after delivery, return the goods at the supplier’s risk and expense and choose a repair, replacement or refund, subject to the CPA. A store policy cannot override these statutory rights.
13.4 Voluntary returns and exchanges for non-defective goods: except where the law requires otherwise, any return or exchange for change of mind, buyer’s remorse, incorrect selection, or fit issues is a discretionary courtesy governed strictly by our Returns & Refunds Policy.
13.5 Unless we decide otherwise in writing, sale, promotional, clearance, end-of-range, special-order, custom-made, team-branded, personalised, opened hygiene-sensitive items, and gift cards/vouchers are not eligible for voluntary return or exchange because of change of mind, incorrect selection or fit, subject always to non-excludable statutory rights.
13.6 Any approved voluntary return or exchange may be refused if the goods are not in original resaleable condition, including where:
the item has been worn, used, washed, damaged, personalised or altered;
tags, labels, seals, packaging or accessories are missing;
the goods show signs of dirt, odour, wear, field use, court use or fitting beyond normal inspection;
the product was specially sourced or ordered for you.
13.7 We may charge or deduct reasonable direct costs associated with an approved voluntary return or exchange, including courier, re-handling, banking or payment processing costs, to the extent permitted by law.
13.8 For non-defective goods purchased in store, no refund or exchange is available unless:
required by law; or
expressly offered by us in our Returns & Refunds Policy or in writing.
13.9 Transactions arising from direct marketing may attract additional cooling-off rights under the CPA, separate from ECTA, where applicable.
14. Incorrect size, model, fit or suitability chosen by customer
14.1 It is your responsibility to choose the correct size, specification, fit, model, colour and variant before completing the order.
14.2 Size charts, fit notes and staff guidance are general aids only.
14.3 Where the wrong size, model or variant is ordered by the customer, any exchange or return is subject to:
stock availability;
the goods being unused and in original resaleable condition;
our Returns & Refunds Policy;
the customer bearing the direct return and re-delivery costs, unless the law provides otherwise.
14.4 We are not responsible for incorrect orders caused by failure to review your cart, size selection, variant selection, quantity or delivery details before completing checkout.
15. Special orders, teamwear, personalised and branded goods
15.1 Goods that are specially sourced, team-branded, embroidered, printed, customised, assembled to order, cut to specification, personalised or made to your requirements may not be cancelled, returned, refunded or exchanged once procurement, printing, branding, processing or production has commenced, except where required by law.
15.2 You are responsible for approving names, numbers, spelling, colours, sizes, logos, artwork placements and branding instructions before production begins.
15.3 Desnic Sports is not liable for customer-approved artwork or spelling errors once approved by you.
15.4 Minor variations in colour shade, print placement, stitching, batch, trim or supplier finish that do not materially affect use are not defects.
16. Reviews, comments and user-generated content
16.1 Where the Website allows ratings, reviews, comments, images or other content, you agree not to post anything unlawful, defamatory, infringing, misleading, abusive, offensive, discriminatory, harmful, fraudulent, spam-like or technically harmful.
16.2 You warrant that you have the right to post the content.
16.3 By posting content, you grant Desnic Sports a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt and display that content for Website, marketing, moderation and operational purposes.
16.4 We may remove or moderate content at our discretion.
17. Intellectual property
17.1 All Website content, including text, graphics, layout, product compilations, logos, icons, software, photographs, videos, designs, databases and trademarks, is owned by or licensed to Desnic Sports and is protected by South African and international intellectual property laws.

22. Indemnity
22.1 You indemnify and hold harmless Desnic Sports, its directors, shareholders, staff, agents and service providers against claims, losses, damages, liabilities, costs and expenses arising from:

your unlawful conduct;
your infringement of any third-party rights;

23. Force majeure
23.1 We are not liable for delay or failure to perform any obligation where caused directly or indirectly by events beyond our reasonable control, including:

flood, fire, storm, epidemic or pandemic;
strikes, labour disputes or civil unrest;
war, terrorism or sabotage;
power failures, internet failures, platform outages or cyber incidents;
courier disruptions or fuel shortages;
import delays, customs holds or supplier failures;
governmental action or legal restrictions.
23.2 During a force majeure event, our obligations are suspended to the extent affected for the duration of the event.
24. Suspension or termination
24.1 We may suspend or terminate access to the Website or your account immediately where reasonably necessary to protect the Website, our systems, customers, suppliers or legal interests.
24.2 Termination does not affect any rights or obligations that accrued before termination.

25.3 If a complaint is not resolved internally, nothing in these Terms prevents a consumer from approaching any competent ombud, regulator, tribunal or court, including the Consumer Goods and Services Ombud (CGSO) where it has jurisdiction. The CGSO operates as the compulsory ombud scheme for the consumer goods and services industry, and consumer goods suppliers are expected to comply with that framework.
26. Governing law and jurisdiction
26.1 These Terms are governed by the laws of the Republic of South Africa.
26.2 Subject to applicable law, you consent to the jurisdiction of the Magistrates’ Court having jurisdiction in respect of any dispute arising from these Terms or your use of the Website, provided that Desnic Sports may institute proceedings in any other court of competent jurisdiction where permitted.
27. General
27.1 Amendments: We may amend these Terms from time to time. The updated version will be published on the Website with a revised effective date. Your continued use of the Website after publication of amended Terms constitutes acceptance of the amended Terms.
27.2 Severability: If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed and the remaining provisions will remain in force.
27.3 No waiver: Any failure or delay by us to exercise a right does not amount to a waiver.
